Purpose

These Terms & Conditions explain the rules for using Apna Bazar.

They define the legal relationship between Apna Bazar, Buyers, Sellers, and Website visitors. They also explain the basic responsibilities that apply when a person browses Products, creates an Account, lists Products, places an Order, accepts an Order, makes a payment, requests support, or uses any part of the Platform.

Scope

These Terms apply to the Apna Bazar Website at https://apnabazarmart.in, the Apna Bazar Buyer App, the Apna Bazar Seller App, Buyer Accounts, Seller Accounts, Product browsing, Product Listings, Order placement, Cash on Delivery, online payments through Razorpay, Seller verification, returns, refunds, cancellations, and customer support.

These Terms apply together with the Privacy Policy and other related documents listed in the Related Documents section.

If a specific policy applies to a specific feature, that policy will apply along with these Terms.

Definitions

Account means a Buyer Account or Seller Account created or used on the Platform.

App means an Apna Bazar mobile or web application.

Apna Bazar, we, us, or our means Apna Bazar, operating from Patan, District Durg, Chhattisgarh, India.

Buyer means a person who uses the Platform to browse, order, receive, return, cancel, or request support for Products.

Cash on Delivery or COD means a payment method where the Buyer pays at the time of delivery or handover.

Order means a request placed by a Buyer through the Platform to purchase one or more Products.

Platform means the Apna Bazar Website, Buyer App, Seller App, backend systems, support channels, and related services.

Product means goods listed, displayed, offered, or sold through the Platform.

Product Listing means Product information uploaded or maintained by a Seller, including Product name, image, video, price, stock, category, size, color, description, or other Product details.

Seller means a shop, business, or person that creates a Seller Account, lists Products, receives Orders, or sells Products through the Platform.

Services means the services provided through the Platform.

Website means https://apnabazarmart.in.

1. Acceptance of Terms

By accessing or using the Platform, you agree to these Terms.

You accept these Terms when you browse the Website or App, create or use an Account, verify your mobile number through OTP, place an Order, make a payment, list Products, use the Seller App, contact support, request a refund, return, cancellation, or account deletion, or continue using the Platform after these Terms are updated.

If you do not agree to these Terms, you should not use the Platform.

2. Eligibility to Use the Platform

You may use the Platform only if you are legally allowed to enter into a valid agreement under applicable law.

If you use the Platform for a shop, business, or other organization, you confirm that you are authorized to act for that shop, business, or organization.

You must provide accurate information when creating or using an Account.

Apna Bazar may restrict, suspend, or refuse access where required for safety, fraud prevention, compliance, or Platform integrity.

3. User Accounts

Apna Bazar uses OTP-based registration and login for Buyers and Sellers.

You are responsible for keeping your mobile number, device, and Account access secure. Do not share OTPs with anyone.

You agree to provide true, accurate, and updated information. This may include your name, mobile number, delivery address, shop details, Product details, or verification information, depending on how you use the Platform.

Apna Bazar may verify Account information where required for Seller onboarding, Order processing, fraud prevention, support, or compliance.

You are responsible for all activity that happens through your Account unless caused by Apna Bazar's proven system failure or unauthorized access that is not due to your act or omission.

4. Buyer Responsibilities

Buyers must use the Platform honestly and lawfully.

As a Buyer, you agree to provide accurate mobile number, address, and delivery details, review Product details before placing an Order, pay the Order amount through the selected payment method, be available at the delivery address, not place false or bad-faith Orders, not misuse cancellation, return, refund, support, or grievance processes, and not use the Platform for unlawful purchases or prohibited activity.

Buyer-specific rules may be provided in the Buyer Terms, Refund, Return & Cancellation Policy, Shipping & Delivery Policy, and Payment Policy.

5. Seller Responsibilities

Sellers must use the Platform honestly, lawfully, and professionally.

As a Seller, you agree to provide accurate shop, business, contact, and verification information, list only Products that you are allowed to sell, keep Product Listings accurate and updated, accept, prepare, and fulfil Orders according to Platform rules, cooperate with returns, refunds, cancellations, support, and grievance handling, and comply with applicable laws, product safety obligations, tax requirements, consumer protection rules, and marketplace requirements.

Seller-specific rules are covered in the Seller Agreement, Seller Verification Policy, Product Listing Policy, Prohibited Products Policy, Refund, Return & Cancellation Policy, Shipping & Delivery Policy, and Payment Policy.

6. Platform Role

Apna Bazar operates a hyperlocal commerce and marketplace Platform.

The Platform helps Buyers discover Products, place Orders, make payments, request support, and connect with local Sellers. It also helps Sellers list Products, receive Orders, manage shop information, and participate in local commerce.

Apna Bazar is not the manufacturer of Products listed by Sellers unless clearly stated otherwise.

Sellers are responsible for the Products they list, including Product quality, authenticity, description, price, stock, compliance, and lawful sale.

Apna Bazar may facilitate ordering, payment, support, returns, refunds, cancellations, Seller verification, and marketplace operations. This does not make Apna Bazar the manufacturer of Seller-listed Products.

7. Product Listings

Product Listings must be accurate, lawful, and not misleading.

A Product Listing may include Product name, image, video, category, description, price, stock, size, color, and other relevant details.

Sellers are responsible for ensuring that Product Listings are correct and updated.

Apna Bazar may review, reject, edit, hide, remove, or restrict Product Listings where needed for Platform quality, legal compliance, user safety, fraud prevention, or policy enforcement.

8. Orders

A Buyer may place an Order through the Platform where Products and delivery are available.

An Order is subject to Product availability, Seller acceptance, serviceability, payment status, fraud checks, and Platform rules.

Apna Bazar may cancel, pause, reject, or review an Order where required due to unavailable Products, incorrect pricing, payment failure, delivery issues, suspected fraud, misuse, Seller unavailability, or other operational reasons.

Order-related rights and responsibilities are explained in the Buyer Terms, Seller Agreement, Refund, Return & Cancellation Policy, Shipping & Delivery Policy, and Payment Policy.

9. Pricing

Product prices are displayed on the Platform.

Prices may change from time to time. The price shown at checkout applies to the Order unless there is an obvious error, technical issue, incorrect listing, or fraud concern.

Sellers are responsible for maintaining accurate Product prices for their Listings.

The final amount payable may include Product price, delivery charges if applicable, taxes if applicable, discounts if applicable, and any other charge displayed before Order confirmation.

Apna Bazar may correct pricing errors, cancel affected Orders, or contact the Buyer or Seller where required.

10. Payments

Apna Bazar currently supports Cash on Delivery and online payments through Razorpay.

For online payments, Razorpay may process payment information according to its own applicable terms and policies.

Apna Bazar does not store full card numbers, UPI PINs, bank passwords, or payment instrument credentials.

Payment status, Razorpay order ID, Razorpay payment ID, refund ID where applicable, Order amount, and related payment records may be used to process Orders, verify payments, handle refunds, prevent fraud, and maintain records.

11. Returns, Refunds & Cancellations

Returns, refunds, and cancellations are subject to Product type, Order status, Seller rules, delivery status, payment method, fraud checks, and Platform policy.

Not every Product or Order may be eligible for return, refund, or cancellation.

Refund timelines may depend on payment method, payment service provider, banking systems, and internal review.

12. Shipping & Delivery

Apna Bazar provides hyperlocal commerce services based on serviceable locations.

Delivery availability, delivery timing, delivery attempts, address requirements, failed delivery handling, and related support rules are subject to the Shipping & Delivery Policy.

A delivery estimate is not a guarantee. Delivery may be affected by Product availability, Seller readiness, address accuracy, weather, traffic, operational issues, payment status, or other practical limitations.

13. Intellectual Property

The Apna Bazar name, logo, brand elements, Website, App design, software, text, graphics, page layout, icons, interface elements, and Platform content owned or controlled by Apna Bazar are protected by applicable intellectual property laws.

You may not copy, misuse, modify, sell, reproduce, distribute, or create derivative works from Apna Bazar's intellectual property without written permission.

Sellers are responsible for ensuring that Product Listings, images, videos, descriptions, brand names, and other uploaded materials do not infringe the intellectual property rights of others.

By uploading content to the Platform, Sellers grant Apna Bazar permission to use, display, store, process, resize, publish, and distribute that content as needed to operate the Platform, display Product Listings, process Orders, provide support, and promote the listed Products within the Platform.

14. Acceptable Use

You must use the Platform responsibly, honestly, and lawfully.

You must not use the Platform in a way that harms Apna Bazar, Buyers, Sellers, service providers, support teams, or the public.

You must not interfere with the normal operation, security, reliability, or integrity of the Platform.

15. Prohibited Activities

You must not provide false, misleading, or incomplete information, create fake Accounts, impersonate another person or business, share or misuse OTPs, place fake or fraudulent Orders, upload illegal or misleading Product Listings, manipulate prices or refunds, attempt unauthorized access, use harmful automation, interfere with payments or Seller verification, harass users or staff, use the Platform for unlawful trade or fraud, or violate applicable law, these Terms, or related Platform policies.

Apna Bazar may investigate and take action against prohibited activity.

16. Suspension and Termination

Apna Bazar may suspend, restrict, review, or terminate access to an Account, Listing, Order, payment, refund, or Platform feature where reasonably required.

This may happen if information provided is false, incomplete, or unverifiable, a user violates these Terms or related policies, a Seller fails verification or violates marketplace rules, fraud, abuse, misuse, or security risk is suspected, a legal, regulatory, payment, consumer, or safety concern exists, or continued access may harm Apna Bazar, Buyers, Sellers, or the Platform.

Suspension or termination may affect access to Account features, active Orders, Listings, payments, refunds, or support requests.

Certain records may be retained after suspension or termination where required for legal, tax, payment, accounting, fraud prevention, dispute resolution, grievance, or compliance purposes.

17. Limitation of Liability

The Platform is provided on an "as available" basis.

Apna Bazar works to keep the Platform reliable, secure, and useful, but we do not guarantee that the Platform will always be available, error-free, uninterrupted, or free from technical issues.

To the maximum extent permitted by applicable law, Apna Bazar will not be liable for indirect, incidental, special, consequential, punitive, or exemplary losses, including loss of profit, loss of business, loss of data, or loss of goodwill.

Apna Bazar is not responsible for Product defects, Product descriptions, Seller conduct, Product quality, Product legality, or manufacturer obligations for Seller-listed Products, except where applicable law requires otherwise.

Nothing in these Terms limits rights that cannot be limited under applicable law.

18. Indemnity

You agree to indemnify and hold Apna Bazar harmless from claims, losses, damages, penalties, costs, or expenses arising from your breach of these Terms or related policies, false or unlawful information provided by you, misuse of the Platform, violation of applicable law, infringement of intellectual property or third-party rights, Product Listings, Products, Seller conduct, or business operations where you are a Seller, or fraud, abuse, or unauthorized activity caused by you.

This section applies to the extent permitted by applicable law.

19. Third-party Services

Apna Bazar may use third-party service providers to operate certain parts of the Platform.

Current third-party services may include Razorpay for online payment processing and payment-related services, MSG91 for OTP and service-related SMS delivery, and other technical, hosting, infrastructure, or support providers used to operate the Platform.

Third-party services may have their own terms and privacy practices. Apna Bazar is not responsible for third-party services that are not controlled by Apna Bazar.

Where third-party services process personal information, the Privacy Policy explains the relevant data handling practices.

20. Privacy

Your use of the Platform is also governed by the Apna Bazar Privacy Policy.

The Privacy Policy explains how Apna Bazar collects, uses, stores, shares, and protects personal information. It also explains account deletion, data rights, retention, and contact options.

You should read the Privacy Policy together with these Terms.

21. Account Deletion

You may request deletion of your Account through the App where available or through the Website at https://apnabazarmart.in/legal/delete-account/.

Account deletion is subject to identity verification, pending Orders, payment or refund records, Seller verification records, disputes, grievances, fraud prevention, tax, accounting, legal, or compliance requirements.

Account deletion is not the same as logging out or uninstalling the App.

22. Support and Grievances

You may contact Apna Bazar for support related to Accounts, Orders, payments, refunds, returns, cancellations, Seller verification, Product Listings, or Platform use.

Some issues may require verification of your mobile number, Order details, Seller details, or other information needed to respond properly.

Grievance handling may be subject to the Grievance Policy, Privacy Policy, Refund, Return & Cancellation Policy, Payment Policy, Seller Agreement, or other applicable documents.

23. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Subject to applicable law, disputes will be handled by the competent courts or authorities in [Jurisdiction Placeholder], India.

This placeholder should be finalized after legal review.

24. Changes to These Terms

Apna Bazar may update these Terms from time to time.

When we make material changes, we may notify users through the Website, App, Legal Center, Account notice, or other appropriate channels.

The updated Terms will show the version, effective date, and last updated date.

Your continued use of the Platform after updated Terms become effective means you accept the updated Terms.
